Heard the learned Advocates for the parties. Perused the Company Application and the Affidavit in support thereof. The Applicant i.e. Original Respondent has in its Affidavit stated that one of the Directors who was in charge of negotiating a settlement with the Petitioner did not update the Company about the failure of settlement talks with the Petitioner and ultimately none represented the Company when the matter was listed for Admission on 8th January, 2015. In view thereof, the order dated 8th January, 2015 is recalled. The Advocate for the Applicant / Respondent is directed forthwith publish in the Free Press Journal (in

Nitin 924-CAL-48-2015 English) and Nav-Shakti (in Marathi) that the Company had filed the above Application seeking recall of the order dated 8th January, 2015, on grounds set out in the said Application and by an order dated 22nd January, 2015, the order dated 8th January, 2015, stands recalled. The cost of publication shall be borne by the Company.

The Application is accordingly disposed of.
