Since the dispute between the parties has been referred to arbitration ,learned counsel for the plaintiff seeks leave to withdraw the suit. On 7 th October, 2020 the plaintiff was granted time to give notice to the defendant and their Advocate.

Ms. Monis states today that the notice has been so vide letter dated th October, 2020 which has been duly delivered to the defendant on th October, 2020 as seen from the consignment note attached to the copy of her letter dated 10 th October, 2020 addressed to the defendant.

Ms. Monis further states that the link for joining this video conference has also been provided to the defendant. Defendant and/or his Advocate are not present in the "lobby" nor have they joined this call. In view of the above I pass the following order : (i) Suit is allowed to be withdrawn.

(ii) Refund as per rules (iii) of this Court.
