Heard counsel and considered the affidavit in support alongwith additional affidavit in support dated 5th December 2022. Though we are not entirely satisfied with the explanation given, this being family issue, we shall condone the delay. At the same time, Ms. Nichani is justified in pressing for cost. Applicant/Appellant to pay a sum of Rs.5,000/- (Rupees Five Thousand Only) as cost. The cheque shall be issued in the name of Advocate Ms. R.C. Nichani and the cheque shall be paid within one week from today. It is made clear that if the cheque is not handed over and the cheque is not honoured on presentation, the appeal will get dismissed without further reference to this court.
