When this matter is called out, the learned advocates appearing for respective parties have stated that the disputes in the present suit are settled as recorded in the Consent Terms dated 4th October, 2019. The Consent Terms have been signed by the plaintiff as well as his advocate. Similarly, the Consent Terms are signed by defendant No.1, defendant No.8 and their respective advocates. The Pg 1 of 2
903.s.587.2013.doc Consent Terms are also signed by a company called Dime Securities & Investments Pvt. Ltd. of which the plaintiff is a Director and has signed the Consent Terms for and on behalf of the said company. As far as defendant Nos.2 to 7, 9, 10 and 11 are concerned, the Consent Terms provide that the suit against them stands withdrawn. The plaintiff as well as defendant Nos.1 and 8 are present in the Court. They have stated before me that they have understood the contents of the Consent Terms and have signed the same of their own free will. In these circumstances, the Consent Terms are taken on record and marked "X" for identifcation. All undertakings given in the said Consent Terms are accepted. The suit is disposed of in terms of the Consent Terms. No order as to costs. Refund of court fees, if any, as per rules.
In view of the fact that the suit itself is now disposed of, nothing survives in Notice of Motion No.1269 of 2013 and Notice of Motion No. 562 of 2016 and the same are disposed of accordingly. (B. P. COLABAWALLA, J.) Pg 2 of 2
