Learned Counsel for the Plaintiff seeks leave to withdraw the summons for judgment. He seeks liberty to amend the plaint by bringing on record the invoices on which inter alia the suit is based and which are, in any way, referred to in the plaint. He seeks liberty to annex those invoices to the plaint.

The summons for judgment is dismissed as withdrawn with liberty, as prayed. The Plaintiff is permitted to amend the plaint by incorporating the exhibits referred to above and also making suitable changes in the body of the plaint. Such amendments to be carried out within two weeks from today. After the amendments are carried out, the Plaintiff will be entitled to take out a fresh summons for judgment and serve the same on the Defendant.
