The notice of motion seeks recall of an order of dismissal of the writ petition for non-prosecution.

During the pendency of the notice of motion, the parties have arrived at a memorandum of settlement providing for a full and final settlement of the claims of the Applicant in Application (IDA) No.258 of 2010, who is the Respondent to the present petition. Learned Counsel seek disposal of the writ petition and the application under Section 33C(2) of the Industrial Disputes Act in terms of the memorandum of settlement.

Accordingly, the order of dismissal dated 4 May 2017 is recalled and set aside and the writ petition is restored to file and is disposed of in terms of the memorandum of settlement entered into between the parties on 21 April 2018 and which is kept on record in the petition herein, marked "X" for identification.
