Prayer clause - 1 in the petition reads as under :
(1) Issue writ of Mandamus or Certiorari or any other appropriate writ[s]/direction[s] or order[s] to the Respondent No.2 and 4 for staying the demand of Rs.1,44,60,200/- raised by the Respondent No.2 while completing the re-assessment proceedings for the AY 2012-13 till the disposal of Appeal by the CIT (A) - 33, Mumbai. In the order impugned in the petition, petitioner was directed to deposit 20% of the amount demanded. Against that order, an application had been filed to reduce that amount or waive that amount. That application has been disposed by an order dated 9th March 2020 and petitioner was directed to pay Rs.10 lakhs by 16th March 2020. In view of this order, petitioner has taken out the interim application no.2297 of 2020, Gauri Gaekwad
2/2 422.WP-578-2020.doc which is listed today for amending the petition to bring on record this order. Since nobody is appearing for petitioner, it is not clear whether this amount of Rs.10 lakhs has been deposited. In any event, we have considered the petition with the assistance of Mr. Walve and see no reason to exercise our jurisdiction under Article 226 of the Constitution of India for the relief as quoted earlier.
Petition dismissed. Consequently, interim application also stands dismissed.
We clarify that we have not made any observation on the merits of the matter.
