Learned Counsel for the respondent raised preliminary objection that there is remedy of preferring statutory appeal under section 7-I of the Employees Provident Fund and Miscellaneous Provisions Act, 1952 against the impugned order.

53. wpl 197.19.doc Petition with liberty to challenge 7-A as well as 7-B order in view of the objection raised by the respondent, before CGIT. 3.

Liberty is granted to the petitioner to challenge 7-A as well as 7-B order in view of the objection raised by the respondent before CGIT which is now the Appellate Authority in terms of section 7-I of the Act.

Keeping all contentions open, the Petition is allowed to be withdrawn with liberty to the petitioner to prefer Appeal under section 7-I of the Act. If the Appeal is preferred within a period of 2 weeks from today, objection of limitation will not come in the way of the petitioner.
