Mr. Pratap, senior counsel for plaintiff states that there was an appeal filed by defendant no.1, which was pending and that appeal has been dismissed by a judgment pronounced on 9th December 2019. Mr. Pratap states that nothing survives in this suit and the formal order of dismissal had not been passed because of pendancy of appeal. Mr. Krishnamurthy agrees. Suit, therefore, stands dismissed. Refund of court fees, if any, in accordance with rules.
