Through this Petition filed under Article 226 of the Constitution of India, the Petitioner has challenged the order dated 15th December, 2012 (Exhibit H).

Having gone through the said order, we find that the said order is in favour of the Petitioner. In the circumstances, in our considered view, no relief as claimed in the Petition can be extended to the Petitioner.

In these circumstances, the learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to the Vishal Parekar 1/2
902-wp-719-2014.doc Petitioner to approach the Education Officer in case the order (Exhibit H) is not complied with in its correct perceptive by Respondent Nos. 4 and 5. With the aforesaid observation and liberty to the Petitioner, the Petition is disposed of. 4.
All contentions are kept open.

The parties are at liberty to submit their respective claim before the Education Officer within two weeks. The Education Officer shall examine and see that his earlier order has been complied or not.
