For the reasons set out in the Petition, leave under Clause XIV of the Letters Patent is granted and the Petition is made absolute in terms of prayer clause (a).

There was an ad-interim order dated 2nd February 2016 (Mr. Justice S. C. Gupte). The order was passed after notice. The Defendants have not entered appearance nor filed any Reply. 22nd September 2016

For the reasons set out in the ad-interim order dated 2nd February 2016, it is confirmed as a final order on the Notice of Motion.

Now that leave under Clause XIV has been granted, there will, therefore, also be an order in terms of prayer clause a(ii) of the Notice of Motion.

In addition, the Plaintiffs will be entitled to apply for actual costs of this Notice of Motion at the final hearing of the Suit. (G. S. PATEL, J.) 22nd September 2016
