After the matter is heard at some length, it is agreed between the learned counsel for the parties that the impugned award may be set aside by consent and the disputes and differences between the parties forming part of the award be referred to the sole arbitrator. Accordingly, by consent, the impugned award dated 16 October 2015 is set aside and the disputes and differences between the parties are referred to the sole arbitrator, Mr. Prem Gidwani, Advocate, subject to his disclosure and consent.

All rights and contentions of the parties on merit are kept open. The petition is disposed of in these terms.
