IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION NO.868 OF 2016 Bansilal Pawar & Ors.

...Petitioners

vs.

Municipal Corporation of Greater Mumbai & Ors.

...Respondents

Mr.J.G.Reddy for the Petitioners Mr.Clive D'souza for the respondent No.4 Ms Shital Mane for respondent Nos.1 and 2.

CORAM : A.S.OKA, & P.N.DESHMUKH,JJ.

DATE : FEBRUARY 20, 2018 P.C.:

The consent terms signed by the petitioners' Advocate and the petitioners, the Advocate for the fourth respondent and the fourth respondent, fifth to eighth respondents and their Advocate as well as nineth respondent and its Advocate are taken on record and marked `X' for identification. It is pointed out that all the petitioners and all private respondents are personally present in the Court. We accept the statements made by the learned counsel for the parties.

The learned counsel for the petitioners and the learned counsel representing the fourth to nineth respondents pray that the writ petition be disposed of in terms of the consent terms. As the first to

oswp868 third respondents are not the parties to the consent terms, it is obvious that the order which may be passed will not bind the said respondents.

Accordingly, writ petition is disposed of in terms of the consent terms. However, we make it clear that this order will not bind the first to third respondents as they are not parties to the consent terms and the said respondents are free to take action in accordance with law.

Ad-interim or interim order which was operative till today stands vacated.
