Heard Mr. Velar, learned Advocate for Petitioners. 2.
Present Misc. Petition is filed by the Petitioners for issuance of legal heirship certificate under Section 2 of the Bombay Regulation VIII of 1827 in respect of deceased Siddharth Popat Kharat. Deceased Siddharth P. Kharat is survived by two sons i.e. Kamlesh Kharat and Nikitesh Siddharth Kharat. The names of the legal heirs of deceased in paragraph No.4 of the Petition.

Purpose for filing the present Petition is in paragraph No.6 which reads thus:- "6. The heirship is required for transfer the assets shown in the schedule of Assets standing in the name of the Petitioners and to submit it before MHADA & Cooperative Housing societies. Hereto annexed and marked as Exhibit - D is the Schedule of Assets."

In view of the above, Misc. Petition stands allowed in terms of prayer clause (a) which reads thus:- "a. This Hon'ble Court be pleased to issue a Legal Heirship Certificate to the petitioners under the provision of Bombay Regulation VIII of 1827 certifying that Kamlesh Siddharth Kharat (Son) and Nikitesh Siddharth Kharat (Son) as the legal heirs of the deceased i.e. Siddharth Popat Kharat."

Misc. Petition is disposed.

Issuance of proclamation is dispensed with.
