Both counsel state that the parties have arrived at a settlement. They tender consent terms signed by the parties and their Advocates which provide for payment of sum of Rs.70,00,000/- in installments. The consent terms are signed by the defendants who are identified by their Advocate. 2.

Defendant no. 4 and Defendant no. 5 are present in Court and have also identified signatures of the other defendants. The plaintiffs Advocate has also relied upon resolution authorizing the signatory to execute the consent terms.

Accordingly, I pass the following order :

(i) Suit is decreed in terms of the consent terms. (ii) Decree to be drawn up accordingly.

(iii) In view of the disposal of the suit Summons for Judgment is disposed (iv) Refund of Court fees as per rules.
