CORAM : R.M.BORDE & R.G. KETKAR, JJ.

DATE : 24th JANUARY, 2018 PER COURT :

1.

The petitioner is objecting to the drives of removal of encroachment initiated by the Railways. The petition in the present form is not entertainable and as such, the counsel appearing for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to avail of the remedies as may be available in law.

2.

Since there is an eminent threat of dispossession and demolition and that the members of the petitioner-unregistered association claim to be in possession since 1971, the respondents are directed not to take any coercive action for a period of two weeks from today so as to enable the members of petitioner-Sangh to avail of the remedies available in law.
