There is an Affidavit of 3rd September 2022 filed by the BES&T Undertaking, Respondent No. 1, in compliance with our order dated 29th June 2022. By that order we required details to be provided of the necessary instructions to be issued by the BEST to give effect to the short term measures set out in a previous compliance report stated on an Affidavit dated 28th June 2022. 2.

We have seen the present further Affidavit of compliance and noted its contents. Precautionary measures have been set out. After paragraph 7 there is a listing of six different immediate measures 5th September 2022

8-OSWP-2994-2019.DOC that are being put in place by the BES&T. This is satisfactory for our purposes.

The question of compensation has been previously addressed and does not survive.

We take the further Affidavit on record and accept the statements made in it as undertakings to the Court. 5.

The two Affidavits are to be retained permanently on file and not to be sent for destruction in the normal course. 6.

No further orders are required.
