By consent of parties, the impugned order passed by the Company Law Board on 19 January 2016, is set aside. Company Application No.201 of 2015 is disposed of with no order. It is, however, made clear that all rights and contentions of the parties, on the merits of the controversy, including, the interlocutory orders to be passed in the Company Petition pending before the Company Law Board, namely, Company Petition No.68 of 2010, are kept open. Respondent No.1 will be at liberty to take out a fresh Company Application for interlocutory reliefs pleading such additional facts, as he may choose to. As in the case of
