IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION ARBITRATION PETITION (Lodging) No. 79 of 2019 Larsen and Toubro Ltd.

..Petitioner.

v.

National Agricultural Supply Co. & 2 Ors ..Respondents. Mrs. S.I. Joshi a/with Ms. Jalpa Pitadia, Advocate for the Petitioner.

CORAM : B. P. COLABAWALLA, J.

DATED :- 6th March, 2019.

P.C. :- 1.

This Arbitration Petition has been filed under Section 29-A of the Arbitration and Conciliation Act, 1996 seeking an extension of time for a period of six months to complete the arbitration proceedings and pass a final award. 2.

This arbitration petition has been served on the respondents as is evidenced by the affidavit of service dated 28th February, 2019 tendered today in Court. The said affidavit is taken on record. Despite service none have appeared on behalf of the respondents.

3.

I am informed that even before the arbitral tribunal, though the respondents have been duly served, they have not been appearing in the arbitration proceedings. I am also informed that the matter is now virtually concluded and all that is required is for pronouncement of the award. It is in these circumstances that extension of time is sought which expired on 6th November, 2018. 4.

In view of the aforesaid circumstances, I find that the case is made out for extension of time. The time to complete the arbitration proceedings and pass a final award is extended by a period of six months from today.

5.

The arbitration petition is disposed of in the aforesaid terms. No order as to costs.
