After the matter was argued for some time, Mr. Chhotaray, learned Counsel for the Revenue, on instructions, states that the order dated 15th January, 2016 passed by the Additional Commissioner of Income Tax (Respondent No.2) stands withdrawn. Similarly, all notices issued consequent to order dated 15th January, 2016 also stand withdrawn. The Assistant Commissioner of Income Tax (Respondent No.1) is directed to inform all banks of the petitioner to whom notices have been issued under Section 226(3) of the Income Tax Act, 1961 about the withdrawal of the same.

Mr. Chhotaray states that the Additional Commissioner of Income Tax would now proceed to decide the petitioner's application for stay dated 14th September, 2015 in respect of A.Y. 2012-13 in accordance with law after giving a personal hearing to the petitioner. 3.
In view of the above assurance, Mr. Mistry, learned Senior Counsel for the petitioner seeks leave to withdraw the petition. 4.
