The misc.petition seeks heirship certificate under Section 2 of the Bombay Regulation VIII of 1827. The Petitioner is the daughter of the deceased. The deceased was survived by the Petitioner and her father, who is husband of the deceased. The father has submitted a consent affidavit through the Petitioner herself as his Constituted Attorney. The petition was accepted on 29 August 2017 and a proclamation was issued and duly displayed on the notice board of the court.
Learned Counsel for the Petitioner states that an affidavit of service will be filed within two weeks from today. There is no objection from anyone in response to the proclamation.
Having regard to the averments in the misc.petition and the material produced with the petition, this court is satisfied as to the Petitioner's claim of heirship in accordance with prayer clause (a) of the petition. The petition is accordingly allowed in terms of prayer clause (a). 1 / 2
