COMPANY PETITION NO.1022 OF 1997 On 16th April 2018 the grievance of petitioner's counsel that petitioner is not reverting with instructions was noted. Petitioner was also directed to amend the petition by striking off the name of the company "Wanbury Limited" and correct it to "Pharmaceutical Products of India Limited". Registry was directed to forward a copy of the order to original petitioner.
There is nothing on record to indicate that the registry had forwarded this order. At the same time, in view of the liberty granted by this Court, petitioner's advocate forwarded a copy of the order to petitioner and have filed an affidavit of one Robin Ghurup affirmed on 6th June 2018 in
3/3 which it is stated that copy of the order was served upon original petitioner on 15th May 2018. Original petitioner is still not present. From the office remarks on the cause list it appears that this petition has not been admitted. Therefore, petition stands dismissed. There are seven other petitions listed today, none of which have been admitted. Mr. Mhatre, advocate instructed by M/s. Utangale and Company in company petition no.1141 of 1999 states that company petition no.1141 of 1999 be listed for admission in the next week. Company petition no.1141 of 1999 to be listed for admission on 11th June 2018.
Other petitions, viz., Company Petition No.12 of 1998, Company Petition No.464 of 1998, Company Petition No.764 of 1998, Company Petition No.1016 of 1998, Company Petition No.33 of 1999 and Company Petition No.328 of 1999 are dismissed for want of prosecution. (K.R. SHRIRAM, J.)
