The Learned Counsel for the parties i.e. the Learned Counsel Mr. Pai appearing for the Petitioner and the Learned Counsel Mr. Sawant appearing for the Respondent No.1 tender consent terms evidencing the settlement arrived at between the parties. The said consent terms have been singed by Mr. T. R. Yadav the learned Advocate for the Petitioner and Mr. Sawant the Learned Counsel for the Respondent, as well as by the proprietor of the Petitioner Mr. Hafeez Contractor and the Respondent Mr. Ansari Husain. The representative from the office of the Petitioner, Mrs Mohini Shingote, H.R. Manager, is personally present in court and identifies the signature of Mr. Hafeez Contractor and further states that Mr. Hafeez Contractor informed her that he has signed the consent terms and that they are acceptable to him. The Respondent Ansari Husain is also personally present in court and when put in the box and queried states that he has read and understood the consent terms mmj
wp-628-15-(901) and that the same are acceptable to him and that he has signed them of his own free will and volition. The Learned Counsel pray that the Petition be disposed of in terms of the consent terms. The Learned Counsel Mr. Pai appearing on behalf of the Petitioner states that the Petitioner has no objection to the Respondent withdrawing the amount of Rs.1,61,000/- deposited in this court with accrued interest if any. The consent terms are taken on record and marked as "X" for identification. The Petition is disposed of in terms of the consent terms.
