There is gross delay in filing this Notice of Motion for condonation of delay in filing the second Review Petition. This delay has not been properly explained. Apart from that,

2/2 NMW/71/15 the first Review Petition was dismissed by this Court on merits and it was observed that there was no error apparent on the face of record committed by the Division Bench which dismissed the Petition. In our view, delay cannot be condoned. Even otherwise, if delay is condoned, in our view, second Review Petition is not maintainable. Reserving the right of the Petitioner to challenge the impugned order passed in the Writ Petition as well as in the Review petition, Notice of Motion is dismissed. (A.R. JOSHI, J.) (V.M. KANADE, J.)
