Learned Counsel for the Petitioner - Union of India seeks leave to withdraw the petition on the basis of a settlement agreement between Union of India, Republic of South Africa and M/s. Denel Soc Ltd., who is the Respondent to the arbitration petition. Learned Counsel refers to written instructions in that behalf received from Joint General Manager, Ordinance Factory, Chanda, Chandrapur, under Union of India, Ministry of Defence, enclosing a copy of the settlement agreement. The written instructions, along with the settlement agreement, are kept on record, marked "X" for identification. The commercial arbitration petition is disposed of as withdrawn. No order as to costs. Refund of Pg 1 of 2
