There is no dispute that the facts of this case are identical to the facts in Arbitration Application No.32 of 2015 except that the learned arbitrator appointed by the respondent after filing of this application has not conducted any meeting.

For the reasons recorded in the order passed today in Arbitration Application No.32 of 2015, the arbitration application is disposed of. At this stage the learned counsel for the parties have suggested various names for the purpose of appointing one of them as the sole arbitrator. In the said list, the name of Mr.U.J. Makhija, advocate is suggested by one of the party. Mr.U.J. Makhija, advocate is accordingly appointed as the sole arbitrator. No order as to costs. (R.D. DHANUKA, J.) 1/1
