The learned counsel appearing for the applicant states that the plaintiff was served with a copy of the notice of motion through its Advocate on 2.2.2019. None appears for the plaintiff when the matter was called out. - Page-1/2

Heard the learned counsel appearing for the applicant and the learned counsel for defendant No.1. I have also perused the afÏdavit in support of the notice of motion. The applicant has been appearing all through out in the proceedings. The applicant has explained the delay in detail as to why the written statement could not be filed within time prescribed and also explained the delay in filing the written statement. The reasons recorded in the afÏdavit in support of the notice of motion explaining the delay are accepted. Notice of motion is accordingly made absolute in terms of prayer clause (a) and (b). 3.

OfÏce is directed to accept the written statement of defendant No.2 within one week from today. The applicant is directed to serve a copy of the written statement to the counsel appearing for defendant No.2 within one week from today.
