The learned Advocate appearing for the Petitioner states that the above Petition is not pressed against Respondent No. 2 - The Maharashtra Housing and Area Development Authority. The statement is accepted. 2.
Heard the learned Advocates appearing for the parties and the following order is passed by consent :
i.
The disputes and differences between the parties arising out of the Development Agreement dated 24th December, 2009 and the Supplementary Agreement dated 9th June, 2010 are referred to the sole Arbitration of Mr. Farhan Dubash, Advocate. ii. The parties and their Advocates shall appear before the learned
Nitin 2 / 2 915-ARBPL-179-2015 Arbitrator in his chambers, on 12th March, 2015 at 5.30 p.m. and obtain necessary directions.
iii. The learned Arbitrator shall endeavour to pass his Award within a period of four months from the date of the first meeting held by him with the parties and their Advocates.
iv. Pending the Arbitration proceedings and for a period of four weeks thereafter, the status quo order dated 3rd February, 2015 shall continue.
v. The cost of arbitration shall initially be borne by the parties equally. vi. All contentions of the parties are kept open. vii. The venue of Arbitration shall be at Mumbai. The above Arbitration Petition is accordingly disposed of. (S.J. KATHAWALLA, J.)
