CORAM : K.R.SHRIRAM,J DATE : 3.10.2016 P.C.:- The counsel for the plaintiffs states that the defendant no.1 has died on 4.3.2014 and the defendants' advocate vide their letter dated 26.4.2016 have informed the name and details of the legal heirs of defendant no.1. The counsel for the plaintiffs states that the legal heirs are to be brought on record as defendant nos.1(a) to 1(e). The counsel tenders draft amendment which is taken on record and marked `X' for identification. The counsel appearing for the defendant nos.1 & 2 has no objection. Leave to amend granted. Amendment to be carried out and amended plaint to be served within two weeks. Should the legal heirs wish to file the additional written statement, the same to be filed within two weeks of receiving the amended plaint. The counsel also waives service of fresh writ of summons.

By an order dated 26.3.2007 this court was pleased to grant ad-interim relief. The plaintiffs confirm having deposited an amount of Rs.1,95,00,000/- which is invested by the Prothonotary & Senior Master, High Court, Bombay. The counsel states that they are ready to go on with the trial in the suit and the ad-interim order in the motion be confirmed as order in the Notice of Motion. The order dated 26.3.2007 is confirmed as order in the Motion. Notice of Motion accordingly disposed. Suit be listed for directions on 18.11.2016.
