This petition challenges a notice issued under Section 354A of the Mumbai Municipal Corporation Act and a speaking order passed by the Executive Engineer of the Corporation (Respondent No.2) on 25 January 2002 proposing demolition of the suit structure. Learned Counsel for the Respondent Municipal Corporation points out that the suit structure has already been fully demolished. Learned Counsel produces photographs in support of his statement. Having regard to these photographs, learned Counsel for the Petitioners seeks leave to withdraw the petition with liberty to raise an appropriate challenge and seek appropriate remedy before an appropriate forum, as his clients may be advised.
