Learned counsel appearing for the petitioner invited my attention to the judgment of Supreme Court in case of Aravali Power Company Pvt. Ltd. vs. M/s.Era Infra Engineering Ltd. 2017 SCC OnLine SC 1072 and would submit that in view of the said judgment of Supreme Court, the petitioner does not press the reliefs in this petition at this stage and would agitate the issues raised in this petition along with challenge to the arbitral award if the petitioner is aggrieved by such award. Statement is accepted. Arbitration petition is disposed of in the aforesaid terms with liberty to raise such contentions in the arbitration petition impugning the arbitral award if the same is adversed against the petitioner. No order as to costs.
