Learned Counsel for the parties inform the Court that the first Respondent is facing insolvency proceeding and an Interim Resolution Professional ('IRP') has been appointed of the first Respondent Company. Learned Counsel for the Petitioner submits that his client has already filed a proof of claim before the IRP. Learned Counsel submits that he may not press for interim relief as of now, but would seek liberty to apply for appropriate reliefs before an arbtiral forum under Section 17 of the Arbitration and Conciliation Act, 1996. The petition is disposed of as not pressed with liberty as prayed for. No order as to costs.
