Having heard both sides and finding that the Presiding Officers of all Debts Recovery Tribunals at Mumbai are not taking-up cases in which Ms.Rohini Amin is appearing as an advocate for any party, we direct that subject securitization application, details of which are set out in prayer clause (a) namely Securitization Application No.26 of 2016 and all proceedings therein, shall stand transferred to Debts Recovery Tribunal, at Pune and the Presiding Officer presiding over the same shall take-up the said application and decide it in accordance with law.

We clarify that we have neither gone into the rival contentions nor merits of the application. We have also not gone into legality and validity of any resolution passed by the Presiding Officers at DRT, Mumbai.

The registry of the Debts Recovery Tribunal, Mumbai shall transmit all papers and proceedings of Securitization Application No.26 of 2016 to the file of Debts Recovery Tribunal, Pune as expeditiously as possible and within one week from the receipt of a copy of this order. All concerned to act on an ordinary copy of this order duly authenticated by the registry of this Court.
