The learned Counsel for the Plaintiff, on instructions, submits that the suit may be permitted to be withdrawn. It is pointed out the One Time Settlement (OTS) was executed with the Defendant - Bank.

It is further submitted that the necessary payment under the OTS has been already made to the Defendant - Bank. 3.

The learned Counsel for the Defendant - Bank confirms the aforesaid statement.

In view of the above, the suit is disposed of as withdrawn. 5.

Pending Notice of Motion/Application, if any, stand Shrikant Malani
