The Petition is for leave under Clause XII of the Letters Patent. The Suit is for declaration arising out of a Share Subscription Agreement. A material part of cause of action has arisen in Mumbai. However some of the properties in question are outside the jurisdiction of this Court although this is not a Suit for land. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to try and entertain the suit.
