The applicant / award debtor has sought to set aside the warrant of attachment levied in respect of Flat No.701 /C, 7th floor Oberoi Sky Height, Lokhandwala Complex, Andheri (West), Mumbai - 400 053. The applicant / award debtor is admittedly the owner of the suit flat. The respondent / award creditor had advanced loan to the applicant. The applicant has paid for the attached flat by way of cheques issued by the respondent / claimant bank and drawn on the Indusind Bank and Bank of Maharashtra. The flat is liable to be attached. The application is misconceived and is accordingly dismissed.

The execution shall proceed.
