This notice of motion has been filed seeking an order of injunction against defendant from disposing of, alienating, transferring, encumbering or creating any third party rights, title or interest in the suit property or parting with possession of the suit property and also restraining the defendant from appointing any other person other than the plaintiff for redevelopment of the suit property. A prayer for appointment of a Court Receiver is also sought. When this notice of motion was moved for ad-interim relief, this Court by its detailed order dated 1st August, 2012 rejected the prayer for ad-interim reliefs. Today 1/2 17-nms-213-14.doc

when the matter is called out none appears on behalf of the plaintiff. It appears that the plaintiff is not interested in prosecuting this notice of motion. In these circumstances, the notice of motion is dismissed for want of prosecution.
