The present Interim Application seeks post grant amendment. Since the Applicant has became aware of certain further shares of the deceased th September, after the grant of Probate which was granted by this Court on 11 2009. The consent Affidavits of the other legal heirs of the deceased are also on record.

I have heard learned counsel, perused a copy of the said Interim Application and find that there is no impediment in granting the same. The amendment is formal in nature and is to give effect to the Probate already Manoj Wakle 1/2

In view thereof the same is allowed in terms of prayer clauses (a) & (b) which read as under:- "(a) to allow the Petitioner to amend the Petition in green colour as per the Schedule annexed hereto as Exhibit "C" and reverify the same. (b) direct the Testamentary Department to amend the Probate dated 8th February 2012 and extended on30th January 2014." 4.
