By this arbitration application filed under section 11(6) of the Arbitration & Conciliation Act, 1996, the applicant seeks appointment of the Arbitrator. A perusal of the agreement dated 22nd June, 2015 indicates that the respondent no.1 is having its office at Dubai. The remedy of the applicant would be to file the arbitration application under section 11(9) of the Arbitration & Conciliation Act, 1996.

Learned counsel appearing for the applicant at this stage seeks liberty to withdraw this arbitration application with liberty to file an arbitration application under section 11(9) of the Arbitration & Conciliation Act, 1996 before the Hon'ble Supreme Court. 1/2
