Heard learned Counsel for the parties.

After the petition is heard at some length, the same is disposed of by consent in terms of the following order : i.

The impugned order dated 7.11.2015 is quashed and set aside; ii.

The complaint ULP No. 215 of 2015 shall be decided by the Industrial Court on merits after framing issue as to whether or not the Respondent is a workman under the Petitioner; iii.

The amount of arrears in terms of clause 3 of the operative part of the order dated 7th November, 2015, be deposited within a period of 4 weeks from today with the Industrial Court. Such deposit to abide by further orders that may be passed by the Industrial Court in the

Priya 2 1 wp 1028-16 complaint;

iv.

In the meantime, during the pendency of the complaint, the Petitioner shall not terminate the services of the Respondent without following due procedure of law; and v.

The Industrial Court shall dispose of the case as expeditiously as possible and in any event, within a period of 6 months from today. ( S.C.GUPTE J. )
