This arbitration petition is filed under Section 9 of the Arbitration and Conciliation Act, 1996. The arbitration agreement between the parties is an international commercial arbitration agreement. Learned Counsel for the Petitioner submits that she has now instructions from her client to invoke the arbitration agreement and seek appointment of an arbitrator and that she will be making an appropriate application in this behalf.

In the premises, the present commercial arbitration petition is disposed of by reserving liberty to the Petitioner to apply for appropriate interim reliefs before the arbitral tribunal as and when it is constituted. All rights and contentions of the parties on merits are kept open. (S.C. GUPTE, J.)
