In this arbitration petition, I had passed an order on 1st March, 2019 whereby the time to complete the arbitration proceedings and pass a final award was extended by a period of one year from the said date. By that very order, with the consent of parties, Mr. Ankit Lohiya (the earlier Arbitrator) was substituted with Mr. Vishal Kanade, an Advocate of this Court, to enter upon the reference and decide the disputes and differences between the petitioners and the respondent herein. The matter was thereafter stood over to today in order to enable the petitioners to file the disclosure statement of the 1/2 3-arbpl-123-19.doc

newly appointed arbitrator as contemplated under Section 11

(8) read with Section 12 (2) of the Act.

The aforesaid disclosure has now been tendered across the Bar and which is taken on record and marked "X" for identification. The learned Advocate appearing on behalf of the respondent has stated that he has no objection to the disclosure as made by the learned Arbitrator. In these circumstances, the arbitration petition is disposed of in terms of my earlier order dated 1st March, 2019. No order as to costs.

It is needless to clarify that the newly appointed Arbitrator shall proceed with the arbitration proceedings from the stage at which they were before the earlier arbitrator. (B.P. COLABAWALLA, J.) 2/2 3-arbpl-123-19.doc
