For the reasons set out in the Affidavit in support, the Notice of Motion is made absolute in terms of prayer clauses (a) and (b). The Affidavit in Support has already been lodged with the Registry. The Petition will now be renumbered as a Suit and will be set down for framing issues on 22nd July 2016.
