Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

Mr. J.P.Sen, Senior Advocate, is appointed as an Arbitrator to decide all the disputes between the parties including the disputes between Trilogic Digital Media Limited.

ii. The learned Arbitrator shall endeavour to pass his Award within a period of six months from the date of the first meeting held before him by the parties.

iii. The above Petition filed before this Court under section 9 of the Arbitration and Conciliation Act, 1996 shall be treated as a Petition under section 17 of the Act by the learned Arbitrator and shall be

Nitin 913-ARBP-230-2015 decided within a period of eight weeks from the date of the first meeting held before him by the parties.

iv. The parties and their Advocates shall appear before the learned Arbitrator in his chamber on 13th February, 2015 at 5.30 p.m. and obtain necessary directions.

v.

Liberty to apply in the event of cheque issued by the Respondents is dishonoured.

vi. The cost of arbitration shall initially be borne by the parties equally. vii.All contentions of the parties are kept open. viii.

The venue of arbitration shall be at Mumbai.

ix. The Respondents shall pay an amount of Rs.1,24,88,928/- to the Petitioner by cheque dated 15th March, 2015. The said cheque shall be handed over by the Respondent and accepted by the Petitioner without prejudice to their respective rights and contentions. The above Arbitration Petition is accordingly disposed of. (S.J. KATHAWALLA, J.)
