We are informed by the Learned Counsel for the Petitioner that the Petitioner has sold the building in question by a registered Deed of Assignment dated 3rd June, 2021. He seeks liberty to withdraw the Petition and to be relieved of the undertaking given to the Court in terms of the order dated 4th April, 2021.

Inasmuch as the Petitioner is no more concerned with the subject Rekha Patil 1/2

2/2 01-WP-728-2021.doc building, we permit the Petitioner to withdraw the Petition. The Petitioner is relieved from the undertaking given to the Court in terms of the order dated 4th April, 2021.

It is made clear that since the interim relief now stands vacated, the Corporation and MHADA would be free to take appropriate steps in accordance with law.
