Mr. Raghunath, Deputy Official Liquidator states that respondent company - Himalaya Fibers Private Limited is already in liquidation pursuant to order dated 13th April, 2017 in Company Petition No.778 of 2014.

In the circumstances, this petition stands disposed with liberty to petitioner to file an affidavit of proof of debt with Official Liquidator. In the event, the order of winding up in company petition no.778 of 2014 is recalled or set aside, liberty is given to petitioner in the present petition, to apply to this Court for revival of the petition and to apply for an order of winding up against respondent company.
