Learned counsel for the appellant seeks leave to withdraw the appeal. The appeal stands dismissed as withdrawn unconditionally. In view of dismissal of Appeal (L) No.144 of 2015 itself, Notice of Motion (L) No.364 of 2015 does not survive and stands dismissed as such.

In view of dismissal of the appeal, the arbitration petition shall be proceeded with before the learned Single Judge

2 of 2 APP(L).144.2015 and the ad-interim order requiring the respondent (Appellant herein) to maintain status-quo in respect of unsold area, shall continue to operate till the next date of hearing before the learned Single Judge.
