The Chamber Summons seeks to correct the name of the Defendant by adding the word "Private" before "Limited". Whatever be the reasons necessitating this change, it can make no possible difference to the outcome of the litigation and I do not think it at all necessary to hear some complex defence on bona fides. The company's correct name is Mondelez India Foods Private Limited and that is how the Defendants to the Suit should be described.

The Chamber Summons is made absolute in terms of prayer clause (a).

Both the Notice of Motion and the Suit will need to be amended. Amendment to be carried out on or before 7th April 2017. Reverification dispensed with.
