In this matter a Memorandum of Family Settlement was filed by the parties in the Supreme Court in Civil Appeal No. 1969 of 2015. On 17th February 2015 the Supreme Court passed an order taking that Family Settlement Memorandum on record and inter alia passing directions in terms thereof and recording the undertakings contained therein. That Memorandum specifically provides that the parties would place copies of it on record in this Court, and, further, that upon jewellery being handed

9-MPT-30-14-TP-39-05.DOC over/exchanged in terms of clause 3(e), Testamentary Petition No. 39 of 2005 would stand disposed of.

Parties are agreed that this exchange of jewellery actually took place and is recorded in a letter dated 28th March 2015 signed by the parties.

In view thereof, copies of the order of the Supreme Court along with the Family Settlement Memorandum and of the letter of handing over the jewellery are placed before me. These are taken on record and marked 'X colly.

In view thereof, by consent, Testamentary Petition No. 39 of 2005 and the Miscellaneous Petition No. 30 of 2014 are disposed of in accordance with above. All interim orders stand vacated. All concerned to act on an authenticated copy of this order. (G. S. PATEL, J.)
