On 1st July, 2015, this Court passed the following order : "1. The learned Advocate for the Plaintiff has tendered a letter dated 10-06-2015 addressed to the Plaintiff seeking instructions in the matter and also informing him that if the Plaintiff fails to give instructions in the matter, they will be seeking discharge in the matter and shall not be responsible if any adverse order is passed in the matter. The learned Advocate for the Plaintiff has informed the Court that they have also informed the Plaintiff over the phone that the matter is placed on board today and that they shall be seeking discharge in the matter if the Plaintiff fails to remain present in Court. However, the Plaintiff is not present in Court. In view thereof, the Advocate for the Plaintiff is discharged from appearing for the Plaintiff in the above Suit. The Suit be placed ssp 1/2

s 3616 of 1996 (910).sxw under the caption for 'Dismissal' on 7th July, 2015, first on board. A copy of this order shall be served by hand delivery on the Plaintiff by the Advocates for the Plaintiff who have just been discharged".

Pursuant thereto, the order dated 1st July, 2015 is served on the Plaintiff on 4th July, 2015. However, none appear for the Plaintiff. In view thereof, the Suit is dismissed for want of prosecution. ( S.J.KATHAWALLA, J. ) ssp 2/2
